By virtue of your web shop usage, www.TerraPiaSkincare.com shall consider that you have been acquainted with these General Conditions and that you accept them. Divita, Inc. shall not be deemed liable for the disputes that might ensue from your failure to read the General Conditions.
The procedure, as well as the buying/purchasing conditions via www.TerraPiaSkincare/shop, are defined by the following steps: order, order overview (basket), payment, delivery, merchandise complaints.

Each person who orders at least a product electronically, fills out the requested data, and sends the order to Divita d. o. o. shall be considered a purchaser. All the prices are expressed in Euros (EUR), with the VAT incalculated, and are valid for a web shop purchase exclusively.
A payment is possible to be transacted in cash payable to a delivery service upon delivery or online via Diners, MasterCard, Maestro and Visa credit cards.
The delivery of the products ordered via our internet store shall be made in cooperation with our GLS delivery service according to a door‐to‐door principle in the territory of the Republic of Croatia exclusively.
Delivery price amounts to 3,98 € and is FREE for a purchase exceeding 35 €.
The delivery service shall be obliged to facilitate an express transportation service from the moment of merchandise upload up to the moment of delivery within a maximal 48‐hour deadline, except for the deliveries on Friday and a delivery to the islands, whereby a delivery time shall depend on a carrier’s timetable. The delivery shall be effectuated weekdays (Monday to Friday) from 8:00 a.m. to 4:00 p.m. There shall be no delivery on weekends.
All the deliveries for which a payment was not made five days subsequent to the ordering (provided that a pay‐in slip/credit cards/e‐banking shall be selected as a payment method) shall be systematically automatically canceled.
Each purchaser shall verify and sign a delivery list upon a merchandise delivery.
A deadline for a notification concerning a replacement of the unopened merchandise in an original wrapping shall amount to seven days.
Product Ordering
The products shall be ordered electronically, conditioned by a purchaser’s preregistration. By selecting the Buy option, a product selected shall be placed in the basket. A merchandise shall be considered ordered when a purchaser completes the overall ordering process and transacts a payment. A confirmation that the order is received shall be sent to an e‐mail address by which a purchaser is registered. The Order Reception Confirmation shall contain the products ordered and the overall order price, as well as a hyperlink to these General Conditions, whereby it shall be implied that Divita, Inc. has fulfilled an obligation to dispatch a Contract to the purchaser. In case that you fail to receive such a Confirmation, we ask you to check whether the products ordered are placed in your basket subsequent to the login. If the basket is empty, we ask you to contact us at info@divita.com. Divita, Inc. shall be obliged to deliver all merchandise ordered. Provided that Divita, Inc. is unable to deliver any of the products ordered, the order shall be reduced by that merchandise, about which you shall be informed via aforementioned Order Confirmation. All other products ordered shall be delivered.
Product Shipment
The products ordered shall be sorted and protected to prevent possible damage during transport. A purchaser shall check a possible damage upon delivery of the merchandise ordered, complain to the deliverer immediately, and return the delivered products on which the external damage is visible. Contrarily, the subsequent complaints shall not be taken into consideration.
Product Delivery
All the products ordered shall be delivered by the contracted GLS courier company. A delivery price shall depend on the value of the merchandise ordered.
In case that a purchaser shall refuse to receive a merchandise delivery due to an unjustified reason or shall fail to take over the product from the contracted courier delivery company, and if the merchandise shall be returned to Divita’s address, Divita, Inc. shall enjoy a right to charge the purchaser the merchandise return costs pursuant to a valid courier company’s price list, based upon a proof of a cost incurred and an invoice that the Divita, Inc. shall present to the purchaser on the basis of the aforementioned source, with a 15‐day maturity.
Complaints and product returns
If you find during the first use that the product you bought is defective or you are not satisfied with it, please contact us.
In accordance with Artice 10 of the Consumer Protection Act, we allow you to send your complaints to the e-mail address: info@divita.hr or by mail to the address: Divita d.o.o., Kozjačka 157, 31 000 Osijek, Republic of Croatia by filling out a complaint form which you can download here.
We will respond to all received complaints as soon as possible by e-mail, and no later than 14 days from the date of receipt of the complaint, and based on your description we will provide you with information on whether the product can be replaced or reimbursed. If the shipment is damaged in transit, such damage is visible when you pick up the shipment, in which case please do not pick up the shipment. Please contact us so we can check the status of the shipment as soon as possible and send you a new one.
We will make a decision on the complaint without delay. The resolution of the complaint, including the elimination of deficiencies, does not take longer than 30 days. Otherwise, you have the right to terminate the purchase agreement. In order to meet the deadline, cooperation on your part is also necessary.
Unilateral termination of the contract
You have the right, without giving a reason, to terminate the Sales contract within 14 days from the day of taking over the goods or after placing the order, in case you have changed your mind before the delivery of the products.
A precondition for unilateral termination of the Sales contract is that the products have not been used and that they are in the original packaging, including the original labels. If the use (impairment) has occurred, upon receipt of the returned products, we will assess the condition of the products according to visible signs of use and accordingly determine what percentage of the refund will be paid. In such situations, we will contact you and try to find the most mutually acceptable solution.
In order to be able to exercise the right to unilateral termination of Sales contract, you must notify us of your decision to unilaterally terminate the Sales contract before the deadline by mail to: Divita d.o.o., Kozjačka 157, 31 000 Osijek, Republic of Croatia or by e-mail to info@divita.hr by filling in a copy of the Form for unilateral termination of the Sales contract , together with the original invoice.
The buyer is not entitled to unilateral termination of the Sales contract if:
- the subject of the Sales contract is perishable or products that expires quickly
- the subject of the Sales contract is sealed products that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery.
If you unilaterally terminate the Sale contract, you will be refunded, including delivery costs if you have borne them, without delay, and no later than 14 (fourteen) days from the date of Divita d.o.o. receive your decision to unilaterally terminate the Sale Contract, provided that you have fulfilled your obligation to return the delivered products.
Return of goods
Return the products or hand them over to us at Divita d.o.o., Kozjačka 157, 31 000 Osijek, Republic of Croatia, without undue delay, and in any case no later than 14 days from the day you sent us your decision to unilaterally terminate the Sale contract. The cost of returning the products are borne by the buyer.
Questions and Objections
Should you have a comment or a complaint related to the purchase of a product purveyed by the www.TerraPiaSkincare.com web shop, we ask you to direct them to ifo@divita.hr. Divita, Inc. shall reply to your inquiry i.e., complaint, in the shortest time possible and shall take all reasonable measures to eliminate the reasons for which the complaint was lodged.

Purpose, Retrieval Mode, and Personal Data Storage:
All personal data shall be used exclusively for the purposes for which they are collected and for which an approval and/or consent was issued. The collected data shall not be made available to the third parties in any way, unless it is not for a legally stipulated purpose or if an explicit approval or consent is not provided.
